SEN5E provides consulting and revenue systems for growth-oriented renovation, design-build and specialty contractors. Our website helps you explore the fit and assess opportunities; a paid engagement requires its own agreement.
1. Scope and agreement
These Terms of Service (“Terms”) govern use of sen5e.ca and its website resources, assessments and booking tools. “SEN5E”, “we”, “us” and “our” refer to the Canadian business operating this website. “You” means the person using it and, where authorised, the business they represent.
By using the website after having a reasonable opportunity to review these Terms, you agree to them to the extent permitted by applicable law. If you do not agree, stop using the website. You must have authority to submit business information or act for another organisation. Nothing in these Terms removes mandatory rights or protections that cannot lawfully be excluded.
2. Permitted use
You may use the website for lawful business evaluation, inquiries and your own internal planning. Provide information that is accurate to the best of your knowledge and submit only material you are authorised to share.
Do not misuse forms or booking tools, send spam, upload malicious code, interfere with security, attempt unauthorised access, harvest personal information or copy content at a scale that disrupts the website or infringes rights. Do not access another person’s saved assessment or share access links without authority. We may restrict access to address misuse, security risks or legal obligations.
3. Assessments, projections and decisions
Assessments and calculators illustrate possible opportunities using your inputs and stated assumptions. Results may rely on estimates, incomplete records or simplified models. They are not audited findings, valuations, guarantees or forecasts of revenue, gross profit or business performance.
Potential gains may overlap and depend on project fit, capacity, margins, demand, execution and other factors. Do not treat every lost inquiry or estimate as recoverable profit. Check the assumptions against your records and operational constraints before making decisions.
Website resources provide general business information. They do not replace legal, accounting, tax, investment or other regulated professional advice. You remain responsible for business decisions and for obtaining advice appropriate to your circumstances. Submitting an assessment or booking a conversation does not create a paid engagement, purchase obligation or professional advisory relationship.
4. Paid consulting and implementation
Paid work is governed by a separate accepted proposal, statement of work or service agreement. That agreement sets the scope, deliverables, responsibilities, schedule, fees, taxes, payment terms, third-party costs, intellectual property rights and any cancellation or termination arrangements.
If that agreement conflicts with these website Terms about the paid engagement, the specific service agreement controls. These Terms do not create subscription charges, refund rules, minimum commitments or performance guarantees. No fee is incurred merely by browsing or submitting an inquiry or assessment.
5. Our content and your submissions
Unless otherwise identified, SEN5E or its licensors own the website’s text, design, brand elements, tools and other content. You may view, print or save reasonable portions for your own internal business use, preserving ownership notices. Reproduction for resale, republication or use in a competing product requires permission, except where applicable law permits otherwise. Third-party names and marks belong to their owners.
You retain ownership of information you submit. You give us the limited permission needed to receive, store, process and use it to respond to your request, provide requested services and operate the website, subject to our Privacy Policy and any applicable service agreement. Submitting information does not give us permission to publish your confidential business figures, use your name as an endorsement or enrol you in marketing.
Use general website forms only for the information requested. Arrange an appropriate secure channel before sending sensitive personal information, credentials or confidential client records.
6. Privacy and electronic communications
Our Privacy Policy describes collection, use, tracking technologies, service providers, retention and your choices. Agreeing to these Terms is not consent to marketing or a substitute for any required privacy consent.
We respond to inquiries and deliver requested information using the contact details you provide. Promotional email and SMS are subject to CASL and the permission or other lawful basis applicable to the message. You can unsubscribe using the method provided or contact info@sen5e.ca. Your carrier may charge for mobile data or messages under your own plan.
Keep saved-assessment links private. Someone with a valid link may be able to view the associated results; activity on shared browsers or forwarded links may be attributed incorrectly. Tell us if you suspect unauthorised access.
7. Third-party tools and availability
The website uses or links to services provided by others, including forms, booking, analytics and advertising platforms. Those services may have their own terms and privacy practices. We do not control their availability or every aspect of their operation. A link is not an endorsement of all content on a third-party website.
We may update, suspend or discontinue website features. Maintenance, outages, browser restrictions and provider changes may interrupt access or affect saved results. Keep copies of information you need. Any commitments for paid services remain governed by the relevant service agreement.
8. Disclaimers and limits of liability
To the extent permitted by law, the website and its free resources are provided “as is” and “as available”, without warranties of accuracy, completeness, uninterrupted availability, fitness for a particular purpose or a particular commercial result. We take reasonable care, but information and tools may contain errors or become outdated.
To the extent permitted by law, SEN5E is not liable for indirect, consequential, special or incidental losses arising from website use, including lost profits, lost opportunities or loss of data. Nothing in these Terms excludes liability for fraud, wilful misconduct or liability that cannot lawfully be limited. Liability for paid services is addressed in the applicable service agreement. These Terms do not restrict privacy rights or statutory remedies.
9. Questions, disputes and changes
Contact info@sen5e.ca with questions or concerns so we can try to resolve them directly. This does not restrict your right to contact a regulator or seek remedies available under law.
These Terms are governed by Ontario law and the federal laws of Canada applicable there, subject to mandatory laws and rights that apply in your jurisdiction. Disputes may be brought before a court with jurisdiction; these Terms do not impose mandatory arbitration or waive statutory complaint rights.
We may revise these Terms and update the date above. Material changes receive appropriate notice. Changes apply prospectively and do not rewrite an existing paid service agreement without the agreement required by its terms. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law.
